Terms of Use

These Terms of Use ("Terms") govern your use of the Nic IQ mobile application ("the App"), provided by Jack Vande Walle ("we," "us," or "the Developer") in the United States. By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You may use Nic IQ only if you are of the legal age to purchase and use nicotine products where you live (21 years of age in the United States). By using the App, you confirm that you meet this requirement. The App is rated 17+ and is intended for adults only.

2. What the App does and does not do

Nic IQ is a neutral tool for logging nicotine use, understanding your patterns, and, if you choose, reducing use at your own pace. The App does not sell, supply, promote, or encourage the use of nicotine or any tobacco product. Estimates shown in the App (such as projected nicotine levels, spending, or savings) are approximations for general awareness and may not reflect your actual physiology or finances.

3. Subscriptions, billing, and free trial

Nic IQ offers an optional auto-renewing subscription, "Nic IQ Pro," which unlocks additional features. The following terms apply:

• Plans and pricing: Nic IQ Pro is available as a monthly plan (US $2.99 per month) or an annual plan (US $14.99 per year). Prices may vary by region and are shown in the App before purchase.
• Free trial: New subscribers may receive a 14-day free trial. If you do not cancel before the trial ends, the subscription automatically converts to a paid subscription at the price shown.
• Auto-renewal: Subscriptions automatically renew at the end of each billing period unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours before the end of the current period.
• Managing and cancelling: You can manage or cancel your subscription, or turn off auto-renewal, in your Apple ID account settings after purchase. Deleting the App does not cancel your subscription.
• Payment: Payment is charged to your Apple ID account through the App Store. Refunds are handled by Apple in accordance with Apple's policies; we cannot issue refunds directly.

4. Your content

You are responsible for the information you enter into the App. Because this data is stored on your device, keeping backups and securing your device are your responsibility.

5. Intellectual property

The App, including its design, text, graphics, and software, is owned by the Developer and protected by applicable laws. You are granted a limited, personal, non-transferable, non-exclusive license to use the App for your own personal use. You may not copy, modify, reverse-engineer, resell, or distribute the App except as permitted by law.

6. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and accuracy. We do not warrant that the App will be uninterrupted, error-free, or that estimates it produces will be accurate.

7. Limitation of liability

To the fullest extent permitted by law, the Developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of, or inability to use, the App. Your sole remedy for dissatisfaction with the App is to stop using it.

8. Changes to the App and these Terms

We may modify or discontinue features of the App, and may update these Terms from time to time. When we update these Terms, we will revise the "Effective" date above. Continued use of the App after changes means you accept the updated Terms.

9. Governing law

These Terms are governed by the laws of the United States and the State of Wisconsin, without regard to conflict-of-law principles.
